Court Fixes May 28 Hearing in Suit Seeking Fresh Police Probe Into Mohbad’s Death

The Federal High Court in Abuja has scheduled May 28 for hearing in a suit seeking to compel the Nigeria Police Force to reopen and deepen investigations into the death of late Nigerian singer Ilerioluwa Aloba, who died in September 2023.

Justice James Omotosho set the date on Monday after the applicant confirmed that all respondents in the case had been duly served with court processes.

The respondents include the Inspector-General of Police, the Nigeria Police Force, and the Commissioner of Police, Lagos State Command.

The suit was filed by the Registered Trustees of Break the Silence Foundation, a non-governmental organisation, which is asking the court for an order of mandamus compelling the police to carry out what it describes as a thorough, independent, and impartial reinvestigation into the circumstances surrounding the singer’s death.

During Monday’s proceedings, counsel to the applicant, Tunde Falola, informed the court that service had been completed on all parties in the case marked FHC/ABJ/CS/636/2026.

Following the update, Justice Omotosho adjourned the matter to May 28 for hearing.

Earlier in April, the court had granted leave for the organisation to initiate the action under Section 4 of the Police Act 2020, which outlines the statutory duties of the police.

The applicant is also seeking an order compelling the police to invite and question individuals who were reportedly last seen with the late singer, including his wife, close associates, and his father, Joseph Aloba, over concerns about the handling of his burial without prior police clearance.

Additionally, the group is urging the court to direct law enforcement to arrest and prosecute anyone found culpable in connection with the singer’s death, based on available evidence.

Mohbad’s passing in September 2023 sparked widespread public outrage, triggering protests and the viral #Justice4Mohbad campaign across Nigeria and beyond, with many alleging possible foul play and questioning the initial investigation.

Nearly three years on, the circumstances surrounding his death remain unresolved, keeping public attention firmly on the ongoing legal and investigative processes.
