Justice Ekwo Orders Substituted Service: Atiku Must Notify Tinubu via APC in 7 Days

The Federal High Court in Abuja has ordered African Democratic Congress (ADC) presidential candidate Atiku Abubakar to serve court processes on President Bola Tinubu within seven days in a suit seeking to prevent the president from contesting the 2027 election.

Justice Inyang Ekwo issued the directive on Wednesday while granting an application for substituted service. The order allows the processes to be served on Tinubu through his political party, the All Progressives Congress (APC).

Atiku’s legal team, represented by Olanrewaju Omotayo-Ojo standing in for Silas Onu, who was said to be bereaved, requested the substituted service before the court.

The suit, marked FHC/ABJ/CS/1888/2026, was filed by Atiku Abubakar as the first plaintiff, with the ADC joined as the second plaintiff. President Tinubu, the APC, and the Independent National Electoral Commission (INEC) are listed as the first to third defendants respectively.

The action alleges that President Tinubu submitted forged certificates to INEC and seeks to stop him from participating in the 2027 presidential election on that ground.
