DSS Set to Open Terrorism Case Against Ex-AGF Malami, Son as Court Fixes Trial Date

A Federal High Court in Abuja has scheduled May 26 for the Department of State Services (DSS) to begin its prosecution in the terrorism case filed against former Attorney General of the Federation (AGF), Abubakar Malami (SAN), and his son, Abdulaziz.

At Tuesday’s proceedings, prosecution counsel, Akinlolu Kehinde (SAN), informed the court that the DSS had filed an amended five-count charge, replacing the initial charges on which both defendants were previously arraigned.

Kehinde subsequently applied to withdraw the earlier charge and requested that the new amended charge be read to the defendants to allow them to take fresh pleas.

The defendants’ counsel, Shaibu Aruwa (SAN), confirmed receipt of the amended charge and did not object to it being read in court.

According to the amended allegations, Malami and his son were said to have, in December 2025, prepared to commit acts of terrorism by unlawfully possessing a Sturm Magnum 17–0101 firearm, 16 rounds of Redstar AAA 5’20 live cartridges, and 27 expended Redstar cartridges without a licence.

When the charges were read, both Malami and Abdulaziz pleaded not guilty.

Following their plea, the prosecution requested a trial date, while the defence counsel did not object but urged the court to maintain the existing bail terms previously granted on February 27.

With no opposition from the prosecution, Justice Joyce Abdulmalik ruled that the defendants should remain on their existing bail conditions.

The court adjourned the matter to May 26 and June 15 for the commencement of trial proceedings.
